These Terms of Service (the “Terms”) govern your access to and use of garagesalesports.com (the “Site”) and any purchase from Garage Sale Sports (“GSS,” “we,” “us,” or “our”). By visiting the Site, creating an account, or placing an order, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these Terms, do not use the Site or place an order.

1. About Garage Sale Sports

Garage Sale Sports is an Arizona-based seller of sports cards, trading cards, collectibles, memorabilia, hobby supplies, sealed products, and related merchandise.

Our online store is hosted by Shopify, which provides the ecommerce platform used to offer products and process orders. Purchases from the Site are transactions between you and Garage Sale Sports, subject to these Terms and any applicable Shopify or payment-provider terms.

2. Eligibility and Account Information

You must be at least the age of majority in your state or jurisdiction to make a purchase. A minor may use the Site only with the involvement and permission of a parent or legal guardian.

You agree to provide current, complete, and accurate account, billing, shipping, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been used without authorization.

You may not use the Site or our products for an unlawful, fraudulent, or unauthorized purpose.

3. Product Listings and Collectible-Specific Terms

We make reasonable efforts to describe and photograph products accurately. Because sports cards and collectibles can have unique characteristics, the following terms apply:

  • Actual-item images: For individually listed cards, slabs, and one-of-one or serial-numbered collectibles, photographs ordinarily show the actual item offered unless the listing clearly states otherwise.

  • Representative images: Stock or representative photographs may be used for supplies, factory-sealed products, or products with multiple identical units. Packaging designs may vary without changing the underlying product.

  • Raw-card condition: Opinions about centering, corners, edges, surfaces, print quality, and overall condition are subjective. A description such as “near mint,” “excellent,” or similar wording is our good-faith assessment and is not a promise that a third-party grading company will assign any particular grade.

  • Graded cards: A grade shown on a third-party holder is the opinion of that grading company. We do not guarantee that another company will assign the same grade, that a card will receive the same grade if resubmitted, or that a holder will qualify for a crossover or reholder service.

  • Sealed products: Packs, boxes, and other sealed products contain randomly inserted items determined by the manufacturer. Unless a listing expressly says otherwise, no particular card, autograph, memorabilia card, serial-numbered card, short print, case hit, or minimum resale value is guaranteed.

  • Manufacturer issues: Factory seals, wrappers, boxes, card surfaces, centering, collation, redemptions, and other contents of sealed products may be affected by manufacturer production or quality-control issues. Manufacturer warranties or replacement programs, when available, are controlled by the manufacturer.

  • Display differences: Lighting, scanners, photography, screen settings, and protective holders may affect how colors, surfaces, and imperfections appear. Customers should review all available images and ask questions before purchasing.

  • Market values: Collectible prices and demand can change rapidly. Product descriptions, prior sales, price comparisons, and other Site content are not appraisals, financial advice, or guarantees of future value, liquidity, or profit.

If a product description conflicts with photographs of a unique item, contact us before purchasing so that we can clarify the listing.

4. Prices, Payments, and Taxes

Prices are listed in U.S. dollars unless stated otherwise. Prices, promotions, and product availability may change without notice before an order is accepted. Shipping charges and applicable taxes are shown during checkout when available.

You authorize us and our payment processors to charge the payment method submitted for your order, including applicable taxes and shipping charges. You represent that you are authorized to use that payment method.

You are responsible for any taxes, duties, customs charges, brokerage fees, or other government assessments not collected at checkout, to the extent permitted by law.

5. Orders, Acceptance, and Cancellation

Your checkout submission is an offer to purchase. An order confirmation acknowledges receipt of that offer but does not necessarily mean that we have accepted the order. We may accept an order by processing payment, beginning fulfillment, or sending a shipment confirmation.

We may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, payment problems, pricing or inventory errors, quantity limits, resale concerns, prohibited transactions, or inability to fulfill the order. If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Requests to change or cancel an order are not guaranteed once fulfillment has begun. Any cancellation rights provided by applicable law remain unaffected.

6. Preorders, Allocations, and Release Dates

A product identified as a preorder, presale, allocation, backorder, or future release is not immediately available for shipment. Manufacturer release dates, distributor allocations, product configurations, and delivery schedules are estimates and may change.

We may limit quantities or cancel and refund a preorder if our allocation is reduced, the product is canceled, or we cannot obtain the product. If fulfillment is materially delayed, we will provide notice and the cancellation or refund options required by applicable law.

Unless a listing or our Return and Refund Policy states otherwise, preorder cancellation requests are evaluated according to the status of the order and applicable law.

7. Shipping and Delivery

Shipping methods, estimated processing times, delivery estimates, tracking practices, address requirements, and claims procedures are described in our Shipping Policy and any product-specific listing terms.

Delivery dates are estimates unless we expressly promise a specific date. We are not responsible for delays caused by carriers, weather, incorrect addresses, customs, or events outside our reasonable control, but we will comply with applicable laws governing delayed or unfulfilled orders.

Customers are responsible for entering a complete and accurate shipping address. If an order is returned because of an incorrect, incomplete, refused, or undeliverable address, any reshipment or refund will be handled under our Shipping Policy, Return and Refund Policy, and applicable law.

Please report missing, damaged, or materially incorrect orders promptly and retain the packaging, shipping label, and item while a claim is reviewed.

8. Returns and Refunds

Returns, exchanges, cancellations, eligibility periods, return-shipping responsibility, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Returned items must be the same items purchased and must be returned in the condition required by that policy. Product substitution, holder tampering, seal removal, opening a sealed product, alteration, or removal of identifying labels may affect return eligibility, subject to applicable law.

Nothing in these Terms limits any non-waivable warranty, refund right, chargeback right, or other consumer protection available under applicable law.

9. Promotions, Discounts, and Store Credit

Discount codes, giveaways, loyalty benefits, store credit, and other promotions may be governed by additional terms disclosed with the promotion.

Unless stated otherwise, promotions have no cash value, cannot be combined, and may be modified or discontinued before they are redeemed. We may reject use that is fraudulent, abusive, or inconsistent with the promotion’s stated terms.

10. Acceptable Use

You may not:

  • Violate any applicable law or regulation.

  • Infringe the intellectual-property or privacy rights of another person.

  • Submit false, misleading, malicious, or fraudulent information.

  • Interfere with the security, availability, or operation of the Site.

  • Transmit malware or harmful code.

  • Scrape, crawl, copy, or exploit the Site through automated means except as permitted by law or with our written authorization.

  • Attempt to gain unauthorized access to an account, system, or network.

  • Use the Site to facilitate payment fraud, chargeback abuse, product substitution, or other deceptive conduct.

We may suspend or terminate access to the Site for violations of these Terms.

11. Intellectual Property

The Site and its original content—including the Garage Sale Sports name, logos, graphics, photographs, text, page designs, and other materials—are owned by or licensed to GSS and are protected by applicable intellectual-property laws.

You may use the Site for personal, noncommercial shopping purposes. No other license is granted.

Third-party team names, league names, player names, product names, trademarks, and logos belong to their respective owners. Their appearance in product listings is for identification and description and does not imply sponsorship, endorsement, or affiliation unless expressly stated.

12. Reviews, Comments, and Submissions

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and not misleading or infringing.

You grant GSS a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submitted content in connection with our business and marketing, subject to applicable privacy law. This license does not transfer ownership of your content.

We may remove submissions that violate these Terms or applicable law.

Do not send confidential or proprietary information through reviews or public comments.

13. Third-Party Services and Links

The Site may use or link to services provided by Shopify, payment processors, shipping carriers, social-media platforms, marketplaces, analytics providers, and other third parties. Those services may be governed by separate terms and privacy practices.

We are not responsible for third-party websites, content, products, or services that we do not control. A link does not necessarily mean that GSS endorses the third party.

14. Privacy

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy. By using the Site, you acknowledge that you have reviewed that policy.

15. Errors and Availability

Occasionally, the Site may contain typographical errors, inaccurate descriptions, incorrect prices, inventory discrepancies, or omitted information. We may correct errors and update information at any time.

If an error affects an order already placed, we may contact you for instructions or cancel and refund the affected item as permitted by law.

We do not guarantee that every product will remain available or that the Site will operate without interruption.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GSS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.

This disclaimer does not exclude any express product representation made in a listing or any warranty or consumer right that cannot lawfully be excluded.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GSS AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST COLLECTIBLE VALUE, OR LOST BUSINESS OPPORTUNITY ARISING FROM THE SITE, A PRODUCT, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GSS’S TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO GSS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law, including liability that cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless GSS and its owners, employees, and agents from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.

19. Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where federal law or the non-waivable law of your state or jurisdiction applies.

Before filing a legal claim, you and GSS agree to make a good-faith effort to resolve the issue by contacting the other party and allowing a reasonable opportunity to respond.

If the dispute is not resolved, the parties consent to the state and federal courts located in Maricopa County, Arizona, unless applicable law requires a different forum. Either party may bring an eligible claim in small-claims court.

20. Changes to These Terms

We may update these Terms by posting a revised version on the Site and changing the “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.

Your continued use of the Site after updated Terms take effect constitutes acceptance of the revised Terms.

21. Severability, Waiver, and Assignment

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of that provision.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a sale, transfer, reorganization, or other change involving our business, subject to applicable law.

22. Entire Agreement

These Terms, together with the policies and product-specific terms referenced here, constitute the entire agreement between you and GSS concerning your use of the Site and purchases from us.

If product-specific terms conflict with these general Terms, the product-specific terms control for that product to the extent of the conflict.
